Polk County at it again in Cyberchild III Child Porn Internet Sex Sting July 2014

Yet another internet sex sting was announced July 1, 2014 in Polk County.  Sheriff Grady Judd again on television announced the arrest of another sixteen men in this latest child porn sex sting.  Although the facts are not yet public, as a Florida Sex Sting Trial Lawyer,in all likelihood undercover Sheriff’s deputies were again trolling the Internet trying to induce men into either sending or receiving child porn or traveling to meet a minor.  It is important to remember that these men are assumed to be innocent.  In the past, as the true facts unfold we learn that in many of the so called sex stings, it the undercover officers that are the ones luring, seducing and enticing otherwise law abiding men into succumbing to temptation.  If a loved one has been arrested, do not assume they are guilty.  Sadly, most of the time, families and employers abandon men based solely on the criminal charges that are filed.

The Pinellas Sheriff and law enforcement in Pinellas announce today April 14th 2014 the culmination of yet another Pinellas sex sting that has been running for days.  For those of us that follow this subject, it was pretty obvious the sting was running from the suggestive ads that were placed on the Internet several days ago by undercover police officers.  It amazes me that men are still falling for the bait and switch entrapment operations that seem to be successful over and over.  My prediction is that another one will run in Sarasota in the near future.  Sarasota is overdue for another sex sting.  It makes for easy sex crime arrests, good publicity for the Sheriff, and more statistics and TV time for elected officials.

This time the police were actually contacting men on adult sites trying to entice them into traveling to meet a minor or using the Internet to lure, seduce or entice a minor.  Eighteen men were arrested in the latest Clearwater sex sting and more arrests are possible.  Did you know you can be arrested even if you do not travel and meet a minor for sex?   Many men are enticed into sending a picture, usually and inappropriate one of their penis to a chatter that is really a cop.  I have been blogging on these tactics for months and it never ceases to astound me that men actually fall for this police scheme.  You can be sure that the Sheriff will be on ABC news tonight claiming that these men were sex predators looking for children.  I would bet the farm that in every single case, it was the police doing the luring and soliciting.  Does it not bother anyone that the police are actually creating crime?  Who is actually doing the trolling on the Internet?  Who is doing the contacting? 

Now each one of these men will have to appear before a judge and have a bail bond set.  They will get fired from their jobs and many will sit in jail before a bond reduction hearing can be set. The best way to not get arrested is to not commit a crime.  Do not even chat with someone that claims to be a minor.  Never send a dirty pic of your private parts to anyone, much less an undercover officer.  I wish the Media would truthfully report what is going on in these cases.

Is Entrapment a Defense in an Internet Sex Sting case?

As more and more people get arrested and charged with Internet Solicitation of a Minor and traveling to meet a minor, the Courts are presented with this question.  The answer is  that it all depends on the particular facts of the communications and the arrest.  Some courageous judges, fed up with the outrageous police tactics have ruled that in some cases the police conduct actually constitutes “Entrapment” as a matter of law.  In two cases in Manatee County cases from Operation Green Shepherd were dismissed by the judge.  Also, juries are now being educated as to what the police are actually doing and in a recent case I tried in Sarasota County from Operation Intercept a jury acquitted a young man based on “entrapment”.  To win an entrapment case, you have to know how to present it to a Court and most importantly, a jury.  Not all criminal defense lawyers are experienced in raising an entrapment defense in an Internet sex sting case.

When you raise the defense of entrapment, you are basically admitting that you committed the offense but establishing that you were induced or persuaded to travel or chat by improper police conduct.  The truth is that the police are not catching child predators as they claim in their press releases.  The truth is that they are creating crime.  The various task forces receive Federal money and are under pressure to make arrests.  It is a lot easier for them to create a crime than to detect a crime.  Entrapment is a defense to improper police conduct.

How do you prove Entrapment?

I can’t tell you how many times I have heard that statement in reviewing the emails, texts and calls in Internet Sting cases.  As  a Sarasota criminal defense lawyer I have handled sex sting cases in Sarasota, Manatee, Polk, Seminole and Lee Counties.  For some reason, people have the mistaken belief that if they ask someone if they are a cop, the undercover cop has to tell the truth.  Nothing could be further from the truth.  The police acting in an undercover capacity absolutely can lie.  I see this in drug trafficking cases, traveling to meet a minor cases and Internet solicitation cases.  In almost every sex sting case I handle, I see over and over the same thing in the chat strings.  Why do people believe they have to tell the truth?  Who knows?

The police regularly do all kinds of things to trick people into solicitation cases and traveling cases.  They send suggestive pictures.  They invite people over with sexy chats and emails.  They tell them to bring condoms.  They tell them to bring drugs.  This is how they catch people.  In many of the cases, it absolutely in entrapment but it takes a skilled experienced attorney to develop the evidence and get the case dismissed on win it in a jury trial.  The big problem is most people do not have the money to hire a good experienced criminal lawyer.  In most of the traveling cases, the State as a part of a plea offer wants at least 42 months in prison followed by sex offender registration and sex offender probation.  A sentence like that will ruin your life forever.  If a loved one has been busted in one of the operations like Green Shepherd in Bradenton or Operation Intercept in Sarasota and their case is still pending be sure they have real adequate representation.  Unfortunately the public defender has an enormous caseload.  They are good lawyers but terribly overworked.  Call today for a free consultation. Florida is leading the Country in Sex Sting arrests.  That is not because there are more pedophiles here than elsewhere.  It is because law enforcement agencies have found an easy way to pump up their statistics, generate publicity and make money.  Most of the people arrested in Polk , Seminole and Manatee County are not criminals.  They are young men that were entrapped by outrageous police conduct, typically bait and switch tactics.

If a loved one has been arrested, do not assume they are guilty.  Do not abandon them.  It is very likely that they were entrapped and lured and induced to respond to emails or texts by some slick undercover cop tolling the Internet for bored lonely men.  These cases can be defended successfully.  In Polk County that have run sting after sting luring men from all over Florida and enticing them to travel to meet a minor.  The police are not detecting crime, they are creating false arrests to make it look like they are doing their job.

The police post on adult sites like Backpage, Adam4Adam and Craigslist Casual Encounters and time after time as adults.  When they get a response they try and lure lonely men with suggestive comments or “winks” claiming that they are fourteen or fifteen.  Lonely bored young men, many time shy young men fall for this ploy.

How do I find the best sex sting lawyer?

No legitimate lawyer will ever claim he is the “best”.  There are some very fine criminal defense lawyers in Florida.  Not all of them handle sex cases on a regular basis.  You need to find a lawyer that has experience in defending sex cases.  Look at the attorney’s background and education.  How long has he or she been actually defending sex charges?  Beware of out of State lawyers who are really running referral services and will only take your money and then hire someone locally.  Beware of lawyers that will tell you what you want to hear to get you to hire them.  Do your homework.  Go on the Internet.  Go to the Florida Bar site and check for complaints.  It is impossible for any lawyer to represent thousands of people without someone being dissatisfied but beware of any attorney who has multiple sustained complaints.  Make sure the lawyer you hire is the one who is going to handle your case.  Not all lawyers are created equal nor is their level of experience.  Good criminal defense lawyers unfortunately are expensive.  That is because they devote enormous time and effort to presenting a successful defense.  A good example is the recent Zimmerman case.  Would a public defender have won that case?  Take the time to look into the criminal lawyers background, track record and check out his or hers reputation among his peers.  Beware of lawyers that bad mouth other lawyers.  Beware of lawyers that promise a successful result.  No reputable lawyer will do that.

All across Florida they are continuing to run Internet Sex Stings.  In Polk County this month, June of 2013,  it was the ninth sting and it resulted in 41 arrests.  True, they may catch a real predator now and then but in the process they arrest dozens of innocent people destroying their lives forever.  There are valid defenses to these sex crime arrests and having an experienced sex crime lawyer can make a difference.  Under the Florida sentencing guidelines if you are convicted of traveling to meet a minor you are looking at a State prison sentence.  If you get convicted of solicitation of a minor, you are looking at jail.

More and more details are coming out about the latest sex sting in Polk County Florida.  This is the ninth time the Sheriff there has run and Internet Sex Sting and the people still keep coming.
