Here we go again. When crime slows down for the summer, the police simply create offenses. An Internet sex sting will do the trick.

The latest just announced in Daytona and Deltona is called Operation K.I.S.S., as in kiss your ass goodbye if the police have their way.

The Volusia Sheriff and other agencies are at it again claiming to protect the public from online predators. Nothing could be further from the truth. Again they are targeting weak vulnerable men who were looking not for children, but adults. What the police neglect to report is that in almost every instance, they engaged the men first pretending to be an adult. After getting them to chat they then claimed to be underage, about 14 years old. They would then with subtle hints try and get the men to talk about sex or worse yet, send pictures.
This happens every summer. It is a sure fire way to pump up arrest statistics and get publicity. The sad thing is that these sex stings ruin lives. They destroy families and try and label men sex predators for life. If you become a registered sex offender, you experience a lifelong punishment. Being on sex offender probation is a one way ticket to jail. Everyone’s goal is to get you to violate your probation and put you in Florida State prison for years. As a sex sting lawyer, I see all too often the damage they do with basically trumped up entrapment cases.
It is true that occasionally they arrest someone for traveling to meet a minor or solicitation of a minor that really was looking for a minor. Those cases are few and far between. Most of the time they arrest young introverted shy men who are simply weak when it comes to temptation.

Sex is the ultimate bait. A man thinking with the wrong head, particularly when the police send pictures and invitations to come over and have sex, can find himself, arrested, on television and in Court facing a decade in prison. Sex Sting Prosecution in Federal Court in Tampa


An Air Force Sergeant was the latest man to be arrested and prosecuted in Federal Court in Tampa just days ago. The Air Force office of Special Investigations is still running stings on the Internet on and other social medial adult dating sites. All of the details of this latest sting are not available yet, but the prosecution has been filed in Federal Court to take advantage of the harsh Federal Sentencing Guidelines. As a former Federal prosecutor and a former Federal agent, I understand why sometimes cases are filed there instead of the local State Courts. In this instance, the case originated with a military investigation. The military also has the option of proceeding in military court where the defendant’s fate is decided by a panel of officers as opposed to regular citizens. Federal Court is the big league and the penalties there are harsh and oppressive.

In my opinion, the military should deal with military issues and stay out of the sex sting business. I guess it is just too tempting for some of the investigators. Doesn’t the military have enough to do dealing with actual rapes and sex crimes committed by military men or fellow military members? Sex Sting Cases are just too easy to create. It is like shooting fish in a barrel. It is an easy way to run up statistics. I have represented a number of military men in State Court prosecutions in Florida, Alabama and Georgia. I have represented a number of military men in State Court prosecutions in Florida, Alabama and Georgia. Those cases were all filed in State Court. In Clearwater, I handled a case where an Air Force Special Investigator by the name of Glidewell was involved in a purely State investigation and prosecution. That is a direct violation of a Federal Law, the Posse Comitatus Act, a law that specifically prohibits the military from enforcing State laws.

That is probably why now they are bringing Federal prosecutions instead of State cases.

Not all lawyers are admitted to practice in Federal Court and not all lawyers are familiar with the Federal Rules of Criminal Procedure or the Federal Rules of Evidence.

Few are familiar with the military proceedings and not all criminal lawyers have experience defending sex sting or sex crime cases. A successful defense of an Internet Sex Crime takes real know how and experience. These types of cases can be won given the right set of facts, a knowledge of the law, and good hard work. Winning is not an accident. The Internet is a dangerous place. My advice is to stay away from the Internet dating sites and if anyone ever even remotely hints they are a minor, or suggests hooking up with a minor, terminate all communication. Never, no never, travel to meet a minor for anything, much less sex. Imagine being a registered sex offender for life. It just is not worth it. Harsh 2015 Sentences in Internet Sex Sting Cases in Florida
Judges in both Federal and State Court handed out long prison sentences in two Internet sex sting cases this past week. In DeFuniak Springs a man was sentenced as a result of operation “Turkey Hunt” to 25 years in State prison. The man had fallen for the internet sex sting undercover ploy where undercover officers pose as a mother offering her twelve year old daughter for sex. The man traveled to a location to meet the mother with intent to have sex with a child. The defendant in that case was also discharged from the Air Force after 19 years of service. Other men were sentenced in cyber child sting operations to sentences of 38 months, and 36 months.
In Lake Mary Florida, in a Federal case, a man was sentenced to 12 years in Federal Prison by a United States District Judge after falling for a similar pitch where the undercover sex sting officer posed as a father offering sex with two of his children ages 12 and 8. In that case the kids were being offered for $350 dollars. In both of the cases, the age of the alleged victim played a major role in the sentence. Both Judges were swayed by the age portrayed as twelve years old.
Law enforcement in 2015 sex sting operations continues to use the lure of a parent or guardian to get unsuspecting men to travel to meet a minor for sex. The best way to avoid being arrested is to never for a second even think about having sex with a minor. Never engage in any emails, chats or texts that even remotely relate to sex with a minor. There are no moms or dads on the Internet that want someone to teach their daughters about sex. There are no older sisters that want to educate a younger sister about sex. All of these ads are undercover police officers trying to make cases.
I do recognize the right of free speech in America but the Internet sites need to step up and limit access to the adult dating sites. In order to post, there should be age verification. If the police spent more effort keeping real children off the Internet it would solve the problem. For some reason, men continue to fall for the temptation of these suggestive ads. I have yet to see a situation where a real parent is offering a child. I suspect it does not exist but no one knows for sure. One thing for sure however is the fact that no one should ever even think about traveling to engage in sex with anyone underage. If you see such an ad, report it to the police and flag it. Keeping kids off of adult sites would be a great first step. Polk County Sheriff Grady Judd loves the limelight of the television cameras and feeds his ego with press conferences where he parades photographs of all the men whose lives he has destroyed. Hopefully Noah Pransky’s interviews with him will do something to educate the public to the huge lies and the spin put on the various stings running now almost every week in Central Florida in Pinellas, Hillsborough, Lake, Sarasota, and Manatee counties.
I am presently defending a case in Federal Court and as soon as the present trial ends, I will be filing an action in Pinellas attacking some of the illegalities and improper conduct in several of the current cases. There is something huge about to happen relating to how the Internet Sex Stings have been run and the people participating from various branches of law enforcement.
In a deposition a little over a week ago an issue came up that is going to expose the unlawfulness of some of the current police conduct. It is sad that to get votes, Grady Judd puts on a dog and pony show with photographs of the men that have been entrapped in his ICAC operations. In truth about one in ten of the men arrested ever had any intention of soliciting a minor on the Internet. The truth is that the police in almost every instance were the ones luring, soliciting and enticing socially inept young men into traveling to meet a minor. The law is terribly being abused to run up arrest statistics and create press for many of the Sheriffs who have to regularly run for election. They claim they are protecting their voters from sex predators but the truth is they are creating crime, not preventing it.
Each sting costs the taxpayers about $80,000 in manpower. That does not even take into account the money it takes to get the cases through the Court system. They have all missed the boat. The ICAC funding should be spent on educating kids and parents about the dangers of the Internet. How about changing the laws requiring a person on the Internet hookup sites to provide proof of age. Keeping kids off the Internet should be the real goal. No kids on the Internet in Adult sites is the real answer. Require anyone on the sites like Craigslist Casual Encounters, Badoo, Adam4Adam, to provide proof of age before being able to post, search or chat in the strictly adult site. It is a simple answer to the problem. Of course, that will not create the publicity the Sheriff needs to stay in power.

Sarasota Internet Sex Sting Running today, April 26th, 2014

Is 2014 the year of the Internet Sex Stings?  Pinellas County sex sting two weeks ago and another one here in Sarasota this week.  Just as I predicted, the Sheriff here in Sarasota followed suit and ran another so called “sex predator” undercover Internet operation once again targeting men on adult social media sites.  It does not matter that they were not seeking to engage in sex with underage minors.  It does not matter that they posted profiles on adult sites looking for consenting adult women.  It does not matter that they were not initiating contact.  When the smoke clears and the true facts come out, in almost every one of the sex sting arrests the police will be shown to be the driving force, bringing up sex and inviting men to travel (to get arrested)

It is like shooting fish in a barrel for the cops.  The FDLE post enticing photos.  The internet task force contact men and make suggestive comments.  Sex is the ultimate bait and my bet is that by the time this current sting is over, twenty or more men will be entrapped into traveling to meet a minor or tricked into sending suggestive sex photos to what the under cover cops claim is a young girl.  They will run the same “home alone” lingo.  The best way to not get arrested is to not commit a crime.

Never email a person if they claim to be a minor it is usually the cyber police.  Even if they start off saying they are an adult and then say something like “sorry, I lied about my age” terminate all contact immediately.  Do not even think about having sex with anyone under 21.  I know that is a few years over the limit but don’t take any chances.  It is sort of like catching a grouper that is barely over the limit.  Don’t take a chance.  Throw it back just to make sure.  Demand that anybody you email with send you proof of age.  Do not accept their word for it.  Demand proof of legal age.  Never travel to any house to meet with anyone.  Always meet only adults only in public places.  The Internet is a dangerous place. Craigslist is full of serious predators.  Some of them are cops trained and trying to talk you into committing crime.  I am not saying don’t get caught.  I am saying don’t even think about sex with anyone remotely underage. The latest stings are targeting gay men.  Be careful about, and the other sex hookup sites.  As Sarasota criminal defense attorney, I have handled two dozen sex sting cases in Lee, Sarasota, Manatee, Seminole, Hillsborough and Pinellas County. If you are a man and posted your profile on here is Sarasota or Bradenton, you can expect to be contacted by a Sarasota County Sheriff’s undercover deputy.  If you get a wink, a smile or some response, like “you look cute”, do not assume it is an adult.  When they run the next Internet Sex Sting here in Sarasota the police will be replying to profiles trying to lure, entice and seduce unsuspecting men into compromising situations and traveling to meet a minor.  They will lure you in and then mention that they are only 13 or 14.  They will suggest you send a “pic” in the hope it will be sexually explicit.  As a Sarasota sex crime lawyer, I have been tracking the Internet sex stings all over Florida for the last five years.  Sarasota is overdue for another sting.  The police just ran another sting on Valentine’s day in Bradenton and usually Sarasota follows within a month or so.

If you post on Craigslist, you can expect to be contacted.  If you see something like “my parents are gone for the weekend” don’t even think about responding.  If a person even mentions they are underage, do not respond and flag the post.  There are not young girls on these sites.  Young girls don’t need men to teach them about sex.  There are lots of boys their age to do that.

Do not get talked into doing something and do not be tempted out of curiosity to respond.  Your only “hookup” will be with handcuffs.  Another Operation Intercept is long overdue for Sarasota and sure to come.  You don’t want to see yourself on television as part of the Sheriff’s pronouncement that “more sex predators have been arrested in Sarasota.  I have defended these sex crime charges in Lee, Sarasota, Manatee, Hillsborough, Pinellas and Seminole County.  In the next Sarasota sex sting, you can expect to see the police target gays and military men and others looking for a NSA relationship.  You can also see them post ads implying that a parent or guardian wants someone to teach their son or daughter about sex.  If you see “Single Mom”, do not respond.  If you see “home alone”, do not respond.  Curiosity killed the cat.

Do not become a registered sex offender for life.  Do not end up in State prison or on Sex offender probation wearing an electronic monitor.  Think twice

More Police Entrapment in Seminole County Operation Safe Net

 Law enforcement put their typical spin on the latest Internet Sex Sting in Seminole County named Operation safe Net.  The operation called Safe Net tricked 26 men into traveling to meet a minor.  Sadly, the public may never know the truth about how these men were lured and seduced by the undercover police.  When you read the media reports, they claim that the men were trolling the Internet searching for sex with a minor.  When you actually look at the facts you will see that it is the police that were trolling the Internet trying to lure men into chat, email and texting with undercover cops. As an experience FLORIDA SEX STING LAWYER I have handled a case in Seminole County.

The Bradenton Sheriff, Brad Steube, finally on February 18th 2014 came forward with the public announcement that another 25 men were arrested in the latest Internet sex sting in Manatee County.  I have been blogging on this since it started last week.  In the press release they make it sound like they have apprehended sex predators.  The truth is that, just as in the Pinellas County, Clearwater, Sarasota, Fort Myers, Lakeland, Tampa, Hillsborough, Seminole, Polk, Pasco, lake County, St Johns, Jacksonville and north Florida Cyber underage sex stings, it is the sheriff’s office and the participating police agencies that are the real sex predators.  If the public only knew the truth.  Twenty five lives have now been destroyed by police entrapment.  When the truth finally surfaces, and it will, the public will find out that the police were contacting adults on adult sites on the Internet.  The police were lying and posting profiles as women as old as thirty one.  The police were bringing up the subject of sex, inviting men to travel and were the ones doing the soliciting and seducing.  What the police are doing should be a crime.

In the latest sting, the police went way overboard.  When they finally did the bait and switch and mentioned age, many of the men balked or terminated conversation.  The police at that point are supposed to quit.  In many of the cases, they did not.  They, the cops, would reinitiate contact and go out of their way to entice the men into further conversation.  Some of the men traveled to warn what they thought was an under aged girl about the dangers of the Internet.

I watched this one unfold all weekend.  You could see the police ads and profiles in some of the dating sites like Craigslist Casual Encounters,, and  The police were contacting men who were not even remotely looking for a minor.  They were engaging them in chat and texts and actually suggesting sexual encounters.  They would say things like “I am not happy with guys my age”.  Law enforcement is supposed to let the suspect set the “tone and pace” of the conversation.  In most instances, the cops would send a picture of an adult they claimed to be a minor.  The police did all of the luring, seducing and enticing.

If you have a loved one arrested in one of these stings, do not assume they are guilty.  They need your support and help now.  The police held these men in “booking” all weekend to keep them from getting in touch with lawyers and their relatives.  The men now have all lost their jobs and many cannot afford an experienced sex crime lawyer.  These cases are defensible.

If you have been arrested as a result of an Internet Sex Sting in Polk, Manatee, Sarasota, Hillsborough or Orange County and you are facing a trial date, you are facing one of the most difficult decisions of your life.  In most cases, the State Attorney will make a plea offer.  Those offers vary dramatically from County to County.  In some areas, the State attorney will make a reasonable offer.  In others, they take a hard line.

If you are charged with traveling to meet a minor, Internet solicitation of a minor or Internet solicitation of a parent of a minor, the Florida sentencing guidelines are harsh and you are facing at least 42 months in State prison.  In many instances, if you have a good attorney, you may get an offer to allow you to plead to a lesser offense like attempted child abuse or some other non sex offense.  These offers to lesser charges come with strings.  The State may want you to agree to sex offender probation even if you are not required to become a sex offender.
You have to make a tough decisions setting certain priorities.  If your number on priority is to stay out of State prison, you should seriously consider that offer.  State prison for a young man is a dangerous place and jail rape is a real problem you might encounter.  Doing time in the County jail sometimes is an alternative and the situation in terms of personal safety is much better there.

The big thing you need to consider is whether or not you get an offer to plea to a non sex offense.  Many of the sex offenses make you a registered sex offender for at least twenty years and that means major problems in your life in terms of where you live, what you can do, how the world treats you and your entire future.  In my opinion, the number one goal should be avoiding being designated a registered sex offender even if that means a short stint in the County jail.  You need to think long term in sex sting cases.

As a sex sting lawyer I have handled dozens of these cases and can honestly tell you, no two cases are the same.  The age of the defendant is a major factor the State considers in making an offer.  The email and text exchanges are other factors to be considered.   Whether or not the police engaged in entrapment is another factor that may influence the decision as to whether or not to go to trial.  Most importantly is the history of the judge when it comes to sentencing.  Some Courts impose harsher sentences if you go to trial and reward defendants who take the first step towards rehabilitation and enter a plea.

Talk to you lawyer.  If you have a public defender, make an appointment and go in and discuss the details of your case.  Many people regret their decision and have second thoughts later in life.  You need to make an informed decision considering all the factors.  If you have already made the tough decision and regret it, there may be alternatives.
