Law Enforcement still at it running Sex Stings in Walton and Osceola County in the last week of November. The latest ploys involve cops posing as parents offering their kids for hookups on the Social Media sites and Chat rooms. The ads they post usually say something like “Single mom wants help with her attractive daughter” or “Open minded single dad wants daughter to learn”. If you see an ad like this or anything close, it is absolutely an undercover sex sting operation. Never respond to any advertisement or text or chat that suggests offering an underage person for sex. Do not get entrapped by this type of police conduct. The best way to avoid an arrest is to not commit a crime no matter how tempting the police make it appear.
The simple fact is, parents do not offer their children for sex and single moms do not need your help teaching their daughters about sex. The police in Polk and Osceola County and the officers involved in the ICAC operations run these sex stings over and over and the arrests still keep coming. They have an incentive. The various Counties get massive Federal funding and need to produce statistics and results to justify the money they get. They get to forfeit the cars they seize and find it much easier to create a crime by entrapping innocent people on the Internet.

It is a crime to solicit a minor or a person posing as a parent of a minor so do not under any circumstances reply to any chat or text that even remotely suggests such a sexual encounter. If you have been arrested as a result of an Internet Sex Sting in Polk, Manatee, Sarasota, Hillsborough or Orange County and you are facing a trial date, you are facing one of the most difficult decisions of your life. In most cases, the State Attorney will make a plea offer. Those offers vary dramatically from County to County. In some areas, the State attorney will make a reasonable offer. In others, they take a hard line.
If you are charged with traveling to meet a minor, Internet solicitation of a minor or Internet solicitation of a parent of a minor, the Florida sentencing guidelines are harsh and you are facing at least 42 months in State prison. In many instances, if you have a good attorney, you may get an offer to allow you to plead to a lesser offense like attempted child abuse or some other non sex offense. These offers to lesser charges come with strings. The State may want you to agree to sex offender probation even if you are not required to become a sex offender.
You have to make a tough decisions setting certain priorities. If your number on priority is to stay out of State prison, you should seriously consider that offer. State prison for a young man is a dangerous place and jail rape is a real problem you might encounter. Doing time in the County jail sometimes is an alternative and the situation in terms of personal safety is much better there.
The big thing you need to consider is whether or not you get an offer to plea to a non sex offense. Many of the sex offenses make you a registered sex offender for at least twenty years and that means major problems in your life in terms of where you live, what you can do, how the world treats you and your entire future. In my opinion, the number one goal should be avoiding being designated a registered sex offender even if that means a short stint in the County jail. You need to think long term in sex sting cases.

Is Entrapment a Defense in an Internet Sex Sting case?
As more and more people get arrested and charged with Internet Solicitation of a Minor and traveling to meet a minor, the Courts are presented with this question. The answer is that it all depends on the particular facts of the communications and the arrest. Some courageous judges, fed up with the outrageous police tactics have ruled that in some cases the police conduct actually constitutes “Entrapment” as a matter of law. In two cases in Manatee County cases from Operation Green Shepherd were dismissed by the judge. Also, juries are now being educated as to what the police are actually doing and in a recent case I tried in Sarasota County from Operation Intercept a jury acquitted a young man based on “entrapment”. To win an entrapment case, you have to know how to present it to a Court and most importantly, a jury. Not all criminal defense lawyers are experienced in raising an entrapment defense in an Internet sex sting case.
When you raise the defense of entrapment, you are basically admitting that you committed the offense but establishing that you were induced or persuaded to travel or chat by improper police conduct. The truth is that the police are not catching child predators as they claim in their press releases. The truth is that they are creating crime. The various task forces receive Federal money and are under pressure to make arrests. It is a lot easier for them to create a crime than to detect a crime. How do you prove Entrapment?
For starters, you have to prove that the crime originated in the minds of the police and not your client. Who posted the ad? In what category was it posted? Did the content of the ad contain lies and misstatements? Did the police have to certify they were over 18 to be on the site? Did the ad itself solicit sexual contact? Was the ad misleading? Did the police invite the travel? In the emails and texts, did the police seduce, solicit or suggest sex? Did the police suggest bringing condoms? Did the police send photographs? More Arrests Coming in Tampa Sex Sting
The Florida Department of Law Enforcement ran another Internet sex sting last week October 2013 in Tampa and more arrests are expected over the next few days. They claim they are arresting Internet child sex predators and publicly in their news releases claim that they are protecting children. Nothing could be further from the truth. The truth is that they are creating internet crimes to boost statistics, make arrests and seize vehicles. In this latest sting they intend to arrest people who merely chatted or talked on the phone and did not even travel to meet anyone. There is no end to the length the cops will go to create a crime.
Who is really doing the solicitation and seducing
In reality, it is law enforcement that is in the business of seducing men into talking, chatting, sexting and traveling. The police are still thick on the social media websites like the sex hookup site “Craigslist Casual Encounters”. Most if not all of the people arrested were adults looking for adults. The police will engage someone in chat and then say “I am only 14, I hope that is ok”? If someone on the Internet ever says that, terminate all contact. The simple answer is to avoid trying to hookup on Craigslist Casual Encounters. If the girl even hints she is underage, hang up, walk away, shut up and have no contact whatsoever. Is this a cop trolling and trying to set up a sex sting or is it legit? Either way the best thing is to never go on Craigslist trying to hook up, even with an adult. Jury Finds Airman Not Guilty in Sarasota Sex Sting
North Port man freed in child sex case
On September 11, 2013, ironically, Patriots Day, a Sarasota jury found a young Airman from Tampa not guilty in an Internet Sex Sting case. The young man had visited a sex site called Craigslist Casual Encounters just hours after returning from a one year post in Korea. He was lured and enticed by an ad posted by an undercover officer, a “chatter” used by the police to entice young men into compromising situations. He responded believing she was an adult and then got baited and switched when the officer said of by the way, I am only 14. The young man responded and agreed to simply “hang out” with no agreement to have sex. When he showed up at Walgreens to meet the young lady, he was arrested.
This was a case of classic bait and switch and entrapment and the jury agreed finding him not guilty in short order. The jury was right. I tried that case with another local attorney Darrin Finebloom who brought me in because of my experience in trying sex crime offenses.
The jury panel at first was very prejudiced because of the nature of the charges but ultimately came around and understood that just because you are accused of a sex offense, it does not mean you are guilty. The undercover officer was a Federal Agent who in this case sent the young man pictures of a woman it would be legal to have sex with. This was outrageous deception and the jury agreed. Sex Sting cases can be won with jury verdicts. Some of the judges are now throwing out the more blatant cases of entrapment but others leave it up to the jury. I handle many Internet Solicitation cases and do a lot of sex crime defense. It is great to see this type of illegal conduct by the police exposed. It confirms my faith in our great jury system. You are indeed innocent until proven guilty.
I can’t tell you how many times I have heard that statement in reviewing the emails, texts and calls in Internet Sting cases. As a Sarasota criminal defense lawyer I have handled sex sting cases in Sarasota, Manatee, Polk, Seminole and Lee Counties. For some reason, people have the mistaken belief that if they ask someone if they are a cop, the undercover cop has to tell the truth. Nothing could be further from the truth. In many of the cases, it absolutely in entrapment but it takes a skilled experienced attorney to develop the evidence and get the case dismissed on win it in a jury trial. The big problem is most people do not have the money to hire a good experienced criminal lawyer. In most of the traveling cases, the State as a part of a plea offer wants at least 42 months in prison followed by sex offender registration and sex offender probation. There was a huge nationwide Federal Sex Sting that culminated in arrests all over the United States, including some arrests in Puerto Rico. Fifty five people were arrested in Florida making it one of the principal targeted areas. The sex sting was called ‘Operation IGuardian’ and focused on child pornography. It targeted men who were taking pictures of children and exchanging them on the Internet. Often the sharing of child pornography involves the use of peer to peer file sharing programs where suspects actually allow other people access to their collection by giving out passwords. Why have the Federal authorities targeted sex crimes? The reason is because the Federal Sentencing Guidelines are incredibly tough and if arrested by the Feds for transmitting child pornography a person faces a minimum five years in Federal prison, often more.
