I can’t tell you how many times I have heard that statement in reviewing the emails, texts and calls in Internet Sting cases. As a Sarasota criminal defense lawyer I have handled sex sting cases in Sarasota, Manatee, Polk, Seminole and Lee Counties. For some reason, people have the mistaken belief that if they ask someone if they are a cop, the undercover cop has to tell the truth. Nothing could be further from the truth. The police acting in an undercover capacity absolutely can lie. I see this in drug trafficking cases, traveling to meet a minor cases and Internet solicitation cases. In almost every sex sting case I handle, I see over and over the same thing in the chat strings. Why do people believe they have to tell the truth? Who knows?
The police regularly do all kinds of things to trick people into solicitation cases and traveling cases. They send suggestive pictures. They invite people over with sexy chats and emails. They tell them to bring condoms. They tell them to bring drugs. This is how they catch people. In many of the cases, it absolutely in entrapment but it takes a skilled experienced attorney to develop the evidence and get the case dismissed on win it in a jury trial. The big problem is most people do not have the money to hire a good experienced criminal lawyer. In most of the traveling cases, the State as a part of a plea offer wants at least 42 months in prison followed by sex offender registration and sex offender probation. A sentence like that will ruin your life forever. If a loved one has been busted in one of the operations like Green Shepherd in Bradenton or Operation Intercept in Sarasota and their case is still pending be sure they have real adequate representation. Unfortunately the public defender has an enormous caseload. They are good lawyers but terribly overworked. Call today for a free consultation. (941) 366-3506
There was a huge nationwide Federal Sex Sting that culminated in arrests all over the United States, including some arrests in Puerto Rico. Fifty five people were arrested in Florida making it one of the principal targeted areas. The sex sting was called ‘Operation IGuardian’ and focused on child pornography. It targeted men who were taking pictures of children and exchanging them on the Internet. Often the sharing of child pornography involves the use of peer to peer file sharing programs where suspects actually allow other people access to their collection by giving out passwords. Why have the Federal authorities targeted sex crimes? The reason is because the Federal Sentencing Guidelines are incredibly tough and if arrested by the Feds for transmitting child pornography a person faces a minimum five years in Federal prison, often more.
As a Florida sex sting lawyer I have handled cases in both the Florida State Courts and the Federal Courts. There is a huge difference in penalties and law enforcement knows that if they file the case in Federal Court they have a tremendous advantage. In the past, the Federal Authorities were not involved in a lot of stings. That has all changed and now Federal Agencies are going full bore after people for possessing kiddie porn (child pornography). They are also targeting people for traveling to meet a minor or luring a minor into traveling to meet an adult.
As a former Federal Prosecutor and 25 year veteran criminal defense attorney I can honestly tell you that if you get arrested and indicted on Federal charges you really need to mount a real credible defense or you are looking at years in prison and a lifetime of sex offender registration. You don’t want to be labeled a child predator.
Not all criminal defense lawyers practice regularly in Federal Court. The laws and the rules are different and the unsuspecting inexperienced lawyer has no real chance of success taking on the most powerful government on the planet. The Feds have unlimited resources, unlimited money and unlimited manpower. The laws and the rules are stacked in their favor and unless your lawyer knows the system you are headed for a huge problem.
If you or a loved one are under investigation for child pornography, or if an arrest is coming, call for a free consultation. Sometimes it is possible to negotiate with prosecutors before you are charged. If you are arrested on Federal charges you may be detained without bond. Act now.
